Hiring Compliance: Strategy and Trends for Background Checks

Compliance issues surrounding background checks continue to plague employers and it’s not just about using the proper forms.  Lawsuits filed against employers and background screening providers have become a trend.  Could your screening partner be putting you at risk?  

Introduction to current and emerging compliance challenges within the screening process
Introduction to EEOC involvement in screening process, including, but not limited to Ban-the-Box
Simple rules and procedures that can be adopted to reduce risk of litigation and regulatory non-compliance

The Background Screening Landscape has changed! Are you compliant?

There is a rising trend of class action lawsuits being filed against employers for alleged violations under the federal Fair Credit Reporting Act (FCRA) and most could have easily been avoided.   More often than not, employers are sued for violating FCRA 101—simple rules and procedures that are clearly set out in the law. Most of the claims involve aspects of the employer’s screening process that could be easily remedied to comply with the FCRA such as reviewing the forms used for background screening.  This session will explore the top reasons employers are being sued and areas every organization should review to ensure a compliant process.
